Terms of Service
DIGI GO is a courier marketplace operated by Digital Global Organisation OÜ (Estonian registry code 17438249, registered office Alvari tn 18-5, Lasnamäe linnaosa, 13627 Tallinn, Harju maakond, Estonia; "DIGI GO", "we", "us"). These Terms of Service (the "Terms") govern the use of the DIGI GO mobile application, the digigo.ee website and any related services (the "Platform").
By creating an account, using the Platform or placing an Order you confirm that you have read, accept and will comply with these Terms.
1. Definitions
- Platform
- the DIGI GO mobile application, the digigo.ee website and related services.
- User
- any person who has created an account on the Platform.
- Sender
- a User who orders a delivery through the Platform.
- Courier
- an independent contractor — a sole proprietor (FIE) or a legal entity — who has registered as a courier on the Platform and provides the delivery service.
- Order
- a delivery request created by the Sender on the Platform.
- Bid
- a price and conditions submitted by a Courier for a specific Order.
- Delivery Contract
- the mandate contract concluded between DIGI GO and the Sender upon acceptance of a Bid, under which DIGI GO arranges the delivery with the help of the Courier.
- Service Fee
- DIGI GO’s fee for the use of the Platform and for arranging the delivery.
- Rating
- the 1–5 star mutual rating system between Users.
2. Nature of the service
2.1. DIGI GO acts as the merchant of record for the delivery service. This means that the Sender orders the service from DIGI GO, DIGI GO invoices the Sender for the full price of the Order (Bid amount + Service Fee), and DIGI GO in turn contracts the Courier and pays the Courier the price less the Service Fee.
2.2. The Courier acts on the Platform as an independent service provider. There is no employment relationship or subordination between DIGI GO and the Courier.
2.3. The Platform is available to persons at least 18 years old who have the legal capacity to enter into binding contracts.
3. Account creation and courier verification
3.1. To create an account the User provides correct, complete and up-to-date information and undertakes to keep it current.
3.2. Before submitting the first Bid, a Courier must complete verification. DIGI GO may check an identity document, driving licence (where relevant), vehicle details, the Business Register entry and other documents (e.g. proof of insurance or an activity licence).
3.3. The User is responsible for keeping account credentials confidential. Any suspected unauthorised use must be reported to info@digigo.ee without delay.
4. Sender obligations
4.1. The Sender describes in the Order — accurately — the contents, dimensions, weight, handling requirements (e.g. "fragile", "keep chilled"), pickup and drop-off addresses and preferred time window.
4.2. The Sender ensures that the contents are lawful and that the Sender is entitled to send and transfer them.
4.3. The Sender packages the item so that it withstands normal transport. DIGI GO and the Courier are not liable for damage arising from insufficient packaging.
4.4. The Sender ensures that the recipient is present at drop-off, or clearly specifies an alternative drop-off method in the Order. Any risk associated with an alternative drop-off (e.g. left at the door) is borne by the Sender.
4.5. The Sender indemnifies DIGI GO and the Courier for any damage arising from incorrect information, insufficient packaging or a prohibited shipment.
5. Prohibited shipments
The following items may not be sent via the Platform:
- narcotic and psychotropic substances and their precursors;
- firearms, ammunition, explosives, flammable, radioactive or toxic substances;
- live animals without prior agreement with DIGI GO;
- human remains, organs or biological samples without proper authorisation;
- counterfeit goods or goods infringing intellectual property rights;
- cash, bearer securities or precious metals of significant value;
- prescription medicines without a lawful basis;
- any other items forbidden by law, unfit for transport or dangerous to the service.
DIGI GO and the Courier may refuse to fulfil an Order if the legality or safety of the shipment is reasonably in doubt. In such cases, the costs are borne by the Sender.
6. Bidding and contract formation
6.1. When an Order is posted, verified Couriers in the area may submit Bids. A Bid includes the price and estimated pickup and drop-off times.
6.2. The Sender chooses a Bid at their discretion. Acceptance of a Bid concludes the Delivery Contract between DIGI GO and the Sender at the accepted price.
6.3. If no suitable Bid is received, the Sender may cancel the Order free of charge before accepting a Bid.
7. Price, payments and invoices
7.1. The total price of a delivery consists of the Courier’s Bid amount and the DIGI GO Service Fee. The total is shown to the Sender before Bid acceptance.
7.2. All prices are in euros and include VAT (unless stated otherwise). DIGI GO is registered for VAT under EE102955561.
7.3. Payments are processed by Stripe Payments Europe Limited (Ireland). DIGI GO does not store full card details; these remain within the Stripe environment.
7.4. The Sender is charged after delivery is confirmed. If delivery fails through no fault of DIGI GO or the Courier (e.g. recipient absent, wrong address), a partial charge may apply under section 8.
7.5. DIGI GO issues the Sender a digital invoice, available in the app and delivered by email.
7.6. DIGI GO pays the Courier the Bid amount less the Service Fee, typically within seven (7) business days of delivery confirmation, based on the Courier’s invoice submitted through the Platform.
8. Cancellations and refunds
8.1. The Sender may cancel the Order free of charge before accepting a Bid.
8.2. After a Bid has been accepted:
- if the Courier has not yet set off for pickup and the Sender cancels, DIGI GO may charge a cancellation fee of up to €5;
- if the Courier is already en route to pickup or has already collected the item, a cancellation fee applies that reflects the work performed but does not exceed the full Bid amount.
8.3. If the Courier fails to complete the delivery through their fault (no-show, significant delay, etc.), DIGI GO cancels the Order free of charge and attempts to reassign the Order to another Courier.
8.4. If the Sender is a consumer (a natural person acting outside their trade, business, craft or profession), the 14-day right of withdrawal does not apply to transport and courier services provided at a specific agreed time (Estonian Law of Obligations Act § 53(4)(8)).
8.5. Refunds are usually issued via Stripe to the original payment method within 14 days.
9. Ratings and reviews
9.1. After a delivery, both the Sender and the Courier may rate each other (1–5 stars with an optional comment).
9.2. Users must refrain from false claims, offensive language and disclosing third-party personal data. DIGI GO may remove reviews that do not comply with these Terms.
9.3. Ratings characterise a User’s reputation on the Platform and influence future Bid visibility and preference.
10. Liability and limits
10.1. DIGI GO arranges deliveries and is liable for its own organisational activity. The Courier, as the direct service provider, is liable for the physical transport of the shipment under the Law of Obligations Act.
10.2. DIGI GO’s aggregate liability per Order is capped at €500, except where the damage is caused by DIGI GO’s intent or gross negligence, or where liability cannot be limited by applicable law (e.g. death or personal injury).
10.3. DIGI GO is not liable for indirect or consequential loss, including lost profits, business interruption or data loss.
10.4. Couriers are recommended to hold appropriate liability insurance covering their activity. The Courier bears risk for the shipment from pickup until drop-off.
10.5. For a damaged or lost shipment, the Sender must submit a claim through the Platform within 48 hours of delivery (or of discovering the issue). DIGI GO handles the claim and coordinates the resolution with the Courier.
11. Intellectual property
11.1. All rights to the Platform — including the mobile application, the website, the logo, the design, the texts and the database — belong to Digital Global Organisation OÜ or are used under licence.
11.2. The User has a perpetual, non-transferable and non-exclusive licence to use the Platform in accordance with these Terms. Reverse engineering, decompilation, mass scraping and use for building a competing service are prohibited.
12. Termination and suspension
12.1. The User may close the account at any time from within the app or by writing to info@digigo.ee.
12.2. DIGI GO may suspend or close an account where the User has breached the Terms, submitted false information, is reasonably suspected of fraud, has received repeated low ratings, or has caused material harm to the Platform, other Users or third parties.
12.3. Account closure does not affect financial obligations accrued before closure.
13. Data protection
The processing of personal data is described in a separate **Privacy Policy**, which forms an integral part of these Terms.
14. Reporting illegal content (DSA)
14.1. If you become aware of illegal content, activity or a User on the Platform (e.g. a prohibited shipment, fraud, harassment), notify us at info@digigo.ee. Please describe the content as precisely as possible, its location on the Platform (e.g. an Order ID) and the reason for the report.
14.2. We handle notifications without undue delay in accordance with the EU Digital Services Act. Users whose content has been removed or account has been restricted may appeal through the Platform’s internal complaint mechanism.
15. Changes to these Terms
15.1. DIGI GO may amend these Terms unilaterally. Users are notified of material changes at least 14 days in advance via the app and/or email.
15.2. Continued use of the Platform after the changes take effect constitutes acceptance of the amended Terms.
16. Governing law and dispute resolution
16.1. These Terms and any contracts concluded under them are governed by the laws of the Republic of Estonia.
16.2. Disputes are resolved by negotiation first. Failing that:
- a Sender who is a consumer may turn to the Estonian Consumer Disputes Committee or use the EU Online Dispute Resolution platform;
- other disputes are resolved by Harju County Court (Harju Maakohus) in Tallinn.
